1. Acceptance of Terms
By accessing or using this website and its subscription services (“Service”), you agree to comply with and be bound by these Terms of Website Use (“Terms”). If you do not agree to these Terms, please do not use the Service.
2. Subscription and Automatic Renewal
2.1. By subscribing to our Service, you agree to pay the applicable subscription fees as described at the point of purchase.
2.2. Subscriptions automatically renew at the end of each annual billing cycle, and your payment method will be charged unless you cancel your subscription prior to the renewal date.
2.3. You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellations will take effect at the end of the current billing period.
2.4. No Refunds: No refunds or credits will be issued for any partial subscription periods or for cancellations made before the end of a billing cycle. All fees paid are non-refundable.
2.5. We reserve the right to cancel or suspend your subscription at any time, without notice or liability, for any reason, including but not limited to breach of these Terms or misuse of the Service.
2.6. Subscription Fee Increases: We reserve the right to increase the annual subscription fee by no more than 5% per annum. Any such increase will be communicated to you in advance of your renewal date.
2.7. New Services and Additional Charges: We reserve the right to introduce new services or features that may be subject to additional subscription charges. You will be notified of any such new charges prior to being billed.
3. User Conduct and Misuse
3.1. You agree to use the Service only for lawful purposes and in accordance with these Terms.
3.2. You must not misuse the website by knowingly introducing viruses, trojans, worms, or other material which is malicious or technologically harmful.
3.3. You must not attempt to gain unauthorised access to the website, its servers, or any connected databases.
3.4. Restrictions. You must be at least 18 years old to use the Platform. By accepting these Terms, creating a Trust-A-Forwarder Account, or using the Platform, you represent that you are at least 18 years old. You may not use the Platform or the services if you are an employee, partner, or director of our Competitors or intend to gain access to the Platform in order to compete with the Platform.
3.5 Trust-A-Forwarder Account Ownership. Your use of the Platform is conditioned on your provision of complete, current, and accurate information when registering for a Platform Account. The Platform is intended for business use or in connection with an individual’s trade or profession. As the individual who accepts these Terms, You are the owner of the Platform Account unless you are acting on behalf of a business entity, in which case, the business entity is the owner of the Platform Account. If you accept these terms on behalf of a business entity, You represent and warrant that you have the authority to bind the business entity to these terms. If multiple parties claim to be the “owner” of a particular Platform account, Trust-A-Forwarder will deem the owner to be the person who can demonstrate their ownership (in whole or in part) of the underlying business entity for which the Platform Account was created by providing government-issued documentation of such ownership. If Trust-A-Forwarder is unable to determine the rightful owner of the Platform Account, Trust-A-Forwarder reserves the right to suspend or terminate the Platform Account until the disputing parties have mutually agreed on ownership.
3.6 Intended Use. You may use the Platform only as intended for lawful purposes and in accordance with these Terms. You agree that you will not use the Platform in any way that violates any applicable law or regulation or engage in any Prohibited Uses. In addition, you represent and warrant that:
3.6.1 You will maintain in effect all licenses, permissions, authorisations, consents, and permits necessary to carry out the obligations under these Terms;
3.6.2 You are fully responsible for your actions and the actions of your employees, agents, and customers who use the Platform;
3.6.3 You, your employees, agents will not misrepresent the Platform or the Services;
3.6.4 You will ensure that your employees with access to the Platform Account are bound by these Terms
3.6.5 You own or control all rights in and to all content you provide to Trust-A-Forwarder
3.6.6 You, your employees, will provide reasonable cooperation regarding information requests from law enforcement, regulators, or telecommunication provider; and
3.6.7 You will not give access to the Platform or Services to a direct Competitor of Trust-A-Forwarder,
3.6.8 You will not directly or indirectly reverse engineer, decompile, disassemble or otherwise attempt to uncover or discover the source code, object code or underlying structure, ideas, know-how or algorithms;
3.7 Compliance: You will be solely responsible for your use of the Platform and Services, including
3.7.1 the quality and integrity of any data and other information, including Information, made available to us by or for you through the use of the Platform,
3.7.2 securing and maintaining proper insurance as required, and
3.7.3 compliance with all applicable laws and regulations including but not limited to GDPR, HIPAA and other data privacy laws. Trust-A-Forwarder is not responsible for your compliance with laws and does not represent that your use of the Platform will comply with any laws, including but not limited to GDPR, HIPAA, PCI, Gramm-Leach-Bliley Act, and other similar laws and regulation.
Please be aware that by providing your Content to our platform including any of your Content including product or service, reviews, questions, photographs or videos, comments, suggestions, ideas or the like contained in any of your Content, you grant the Trust-A-Forwarder a nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sublicensable right to
- host, use, reproduce, modify, run, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such Content of yours throughout the world in any media, now known or hereafter devised;
- make your Content available to the rest of the world and to let others do the same;
- to provide, promote, and improve the Services and to make your Content shared on the Services available to other companies, organisations or individuals for the syndication, broadcast, distribution, promotion or publication of such Content of yours on other media and services, subject to our Privacy Policy and this Agreement; and
- use the name and/or trademark that you submit in connection with such Content of yours.
3.8 You acknowledge that Trust-A-Forwarder may choose to provide attribution of your Content at our sole discretion. You further grant Trust-A-Forwarder the right to pursue at law any person or entity that violates your or the Trust-A-Forwarder’ rights in your Content by a breach of this Agreement. You acknowledge and agree that your Content is non-confidential and non-proprietary. You agree that you own or have the necessary licences, rights (including copyright and other proprietary rights), consents and permissions to publish and otherwise use (and for the Trust-A-Forwarder to publish and otherwise use) your Content as authorised under this Agreement.
If it is determined that you retain moral rights (including rights of attribution or integrity) in your Content, you hereby declare that, to the extent permitted by applicable law,
- you do not require that any personally identifying information be used in connection with the Content, or any derivative works of or upgrades or updates thereto;
- you have no objection to the publication, use, modification, deletion and exploitation of your Content by the Trust-A-Forwarder, successors and assigns;
- you forever waive and agree not to claim or assert any entitlement to any and all moral rights of an author in any of your Content; and
- you forever release the Trust-A-Forwarder, successors and assigns, from any claims that you could otherwise assert against the Trust-A-Forwarder by virtue of any such moral rights.
Note that any feedback and other suggestions you provide may be used at any time and we are under no obligation to keep them confidential.
The Services may contain discussion forums, bulletin boards, review services, company profiles or other forums in which you may post your Content, such as reviews of Freight Forwarders experiences, messages, materials or other items ("Interactive Areas"). If Trust-A-Forwarder provides such Interactive Areas on the websites, you are solely responsible for your use of such Interactive Areas and use them at your own risk. The Trust-A-Forwarder do not guarantee any confidentiality with respect to any of your Content you provide to the Services or in any Interactive Area. To the extent that any entity that is one of the Trust-A-Forwarder provides any form of private communication channel between users, you agree that such entity(ies) may monitor the substance of such communications in order to help safeguard our community and the Services. You understand that the Trust-A-Forwarder do not edit or control the user messages posted to or distributed through the Services, including through any chat rooms, bulletin boards or other communications forums, and will not be in any way responsible or liable for such messaging. In particular, Trust-A-Forwarder does not edit or control users’ Content that appears on the websites. The Trust-A-Forwarder nevertheless reserve the right to remove and/or restrict without notice any such messaging or other Content from the Services, where they believe in good faith that such Content breaches this Agreement or otherwise believe the removal and/or restriction is reasonably necessary to safeguard the rights of the Trust-A-Forwarder and/or other users of the Services. Should you disagree with the removal of your Content from the websites, you can appeal our decision through Trust-A-Forwarder's internal complaint handling process. You can find further information on how to object to and appeal a decision to remove or restrict your Content here By using any Interactive Areas, you expressly agree only to submit Content of yours that complies with Trust-A-Forwarder’s published guidelines, as are in force at the time of submission and made available to you by Trust-A-Forwarder. You expressly agree not to post, upload to, transmit, distribute, store, create or otherwise publish through the Services any Content of yours that:
- Is false, unlawful, misleading, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing (or advocates harassment of another person), threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable;
- Is patently offensive to the online community, such as that which promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
- Would constitute, encourage, promote or provide instructions for conduct of an illegal activity, a criminal offense, give rise to civil liability, violate the rights of any party in any country of the world, or that would otherwise create liability or violate any local, national or international law;
- Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy or providing or creating computer viruses;
- May infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party. In particular, content that promotes an illegal or unauthorised copy of another’s copyrighted work, such as
providing pirated computer programs or links to them, providing information to circumvent manufacturer-installed copy-protect devices, or providing pirated music or links to pirated music files;
- Constitutes mass mailings or “spamming”, “junk mail”, “chain letters” or “pyramid schemes”;
- Impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity, including the Trust-A-Forwarder;
- Is private information of any third party, including, without limitation, addresses, phone numbers, email addresses, National Insurance numbers and credit card numbers. Note that an individual’s surname (family name) may be posted to our websites, but only where express permission of the identified individual has been secured beforehand;
- Contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
- Include or are intended to facilitate viruses, corrupted data or other harmful, disruptive or destructive files;
- Is unrelated to the topic of the Interactive Area(s) in which such Content is posted; or
- In the sole judgment of Trust-A-Forwarder, (a) violates the previous subsections herein, (b) violates Trust-A-Forwarder’s related guidelines as made available to you by Trust-A-Forwarder, (c) is objectionable, (d) restricts or inhibits any other person from using or enjoying the Interactive Areas or any other aspect of the Services, or (e) may expose any of the Trust-A-Forwarder or their users to any harm or liability of any type.
To the extent permitted by applicable law, the Trust-A-Forwarder take no responsibility and assume no liability for any Content posted, stored, transmitted or uploaded to the Services by you (in the case of your Content) or any third party (in the case of any and all Content more generally), or for any loss or damage thereto, nor are the Trust-A-Forwarder liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter. As a provider of interactive services, and to the extent permitted by applicable law, Trust-A-Forwarder is not liable for any statements, representations or any other Content provided by its users (including you as to your Content) in the websites or any other forum. Although Trust-A-Forwarder has no obligation to screen, edit or monitor any of the Content posted to or distributed through any Interactive Area, Trust-A-Forwarder reserves the right, and has absolute discretion (or, if you are a consumer resident in the UK or EU, in our reasonable discretion), to remove, screen, translate or edit without notice any Content posted or stored on the Services at any time and for any reason, or to have such actions performed by third parties on their behalf. To the extent permitted by applicable law, you are solely responsible for creating backup copies of and replacing any Content you post or otherwise submit to us or store on the Services at your sole cost and expense. 3.9 Privacy. By using the Platform and providing Information on or through the Platform, you consent to Trust-A-Forwarder's use and disclosure of the Information in accordance with the Privacy Policy available here and incorporated herein by reference. You agree that Trust-A-Forwarder has no responsibility or liability for the deletion or failure to store any Information or content maintained or transmitted on or through the Platform. You represent and warrant that you have provided, and will continue to provide, adequate notices and have obtained, and will continue to obtain, the necessary permissions and consents to provide your customers’ data to us for use and disclosure in accordance with these Terms and our Privacy Policy.
3.10 Login Credentials. You are responsible for maintaining the confidentiality of your Login Credentials. You are responsible for all uses of your Platform Account and Login Credentials, whether or not authorised by you. You agree to notify Trust-A-Forwarder immediately of any unauthorized access to or use of your Platform Account or Login Credentials or any other breach of security. Trust-A-Forwarder reserves the right to disable your Login Credentials at any time in its sole discretion for any or no reason, including if, in HighLevel’s opinion, you have violated any provision of these Terms. Platform Accounts are non-transferable. You are obligated to take preventative measures to prohibit unauthorized users from accessing your Platform Account with your Login Credentials. You give consent to Trust-A-Forwarder to access and monitor your Platform Account for support and security purposes, and/or to perform its obligations under these Terms or to enforce these Terms.
4. Reviews and User-Generated Content
4.1. When posting reviews or any user-generated content on the platform, you agree that:
4.1.1 All statements must be factually true, accurate, and based on your genuine experience.
4.1.2 Content must not contain any offensive, abusive, defamatory, or inappropriate language.
4.1.3 Reviews must not include false claims, misleading information, or personal attacks.
4.2. We reserve the right to remove or edit any content that violates these guidelines, at our sole discretion.
4.3. Disclaimer: Trust-A-Forwarder Limited is not responsible or liable for the content, opinions, or reviews posted by any subscriber or user on the platform. All reviews and user-generated content reflect the views of their respective authors and do not represent the views of Trust-A- Forwarder.
5. Right to Suspend or Terminate
5.1. We reserve the right to suspend or terminate your access to the Service or cancel your subscription at our sole discretion, without notice or liability, if we believe you have violated these Terms or misused the website in any way.
5.2. In the event of termination or cancellation due to misuse or breach of these Terms, you are not entitled to any refund of subscription fees.
6. Indemnification
You agree to defend and indemnify Trust-A-Forwarder and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:
6.1 your breach of this Agreement or the documents referenced herein;
6.2 your violation of any law or the rights of a third party; or
6.3 your use of the Services, including the Tripadvisor Companies’ websites.
7. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the website. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
8. Governing Law
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
